Child Custody
At the heart of many families are the children. Both parents love their children very much and know that the legal proceedings can deeply effect them. Texas has created guideline rules for a Standard Possession Order that many divorced or separated families follow. Generally the Standard Order is the first, third, and fifth weekend of any given month, plus father's day or mother's day respectively, and alternating holidays. In some instances, the possession schedule is best suited as 50/50 possession for both parents and children. However, every family is unique and has certain needs making it important that an experienced attorney helps fine tune visitation to your needs.
Child Support
Even though you may not be able to see your child every day, the court can order that child support be paid monthly. Paying is important because it helps keep your child fed, clothed, in school, and doing what they do best, being a kid. Child support is calculated based on income, living expenses, and ability to provide medical support. Many times the Office of the Attorney General will become involved in a case concerning Child Support. If you are delinquent in payments, the Attorney General may file a Motion for Enforcement against you on behalf of the custodial parent. These should not be dismissed as you can be ordered to do jail time or a warrant if you do not appear in court. It is a common misconception that if you are delinquent in payments, you cannot see your children. Your visitation with your children is not hinged on whether or not you paid your child support that month.
