Types of Divorces
Divorces take many shapes and forms depending on the parties involved. Below are a few of the types of Divorces that can be sought.
- Uncontested Divorce: An uncontested divorces is best when both parties have no assets, property, or children. The parties usually are seeking the same result- to be divorced. While divorce is not always amicable, there is little if any to be fought over and the parties are mostly in need of legal documentation to show they are no longer married.
- No Fault Divorce: If a party no longer wishes to be married the most common divorce is by no fault. This means, neither party is incarcerated, no allegations of adultery, cruelty, or abandonment are made. When the parties have assets and children, certain decision need to be made. These decisions can be difficult for children since many times they don't understand what is happening and are used to seeing their family together. It is helpful to be civil and work together.
- Fault Based Divorce: As mentioned, divorces can be granted if there is an allegation of adultery, cruelty, or abandonment. If a party is convicted of a felony and imprisoned, a divorce can be sought for fault as well. This indicates that one party is a main cause for seeking the divorce and by their actions, has resulted in the detriment of the other party. Many times these are raised in proceedings to help make the party seeking a divorce whole for the past indiscretions of their spouse and may result in a disproportionate division.
Prenuptial and Postnuptial Agreements
Prenuptial and Postnuptial Agreements often are seen as unnecessary or taking out the magic in a marriage. They are actually very useful in maintaining assets when owning a business or remarrying. Both parties must disclose all their assets, voluntarily agree and enter into the agreement, and have it in writing to be legitimized. Whether you are wanting an agreement drafter or reviewed, The Ayon Law Firm looks to help you find an agreement that can work for both parties and their futures.
